Truthy Terms of Service

These Terms of Use (“Terms”) form a legally binding agreement between you (“you” or “User”) and SparkJam Co., Limited (“Truthy”, “Company”, “we”, “us”, or “our”) regarding your access to and use of the Truthy mobile application, website, and related services, features, content, subscriptions, and reports (collectively, the “Services”).

By downloading, accessing, purchasing, subscribing to, or using the Services, you confirm that you have read, understood, and agreed to these Terms. If you do not agree to these Terms, you must not access or use the Services.

These Terms incorporate by reference our Privacy Policy and any additional terms, notices, policies, or disclosures made available within the Services.

Agreement to Terms

Your use of Truthy is subject to these Terms, our Privacy Policy, and any additional rules, notices, or instructions presented within the Services.

We may update these Terms from time to time. The updated version will be effective when posted in the App, on our website, or through another reasonable method. Your continued use of the Services after an update means that you accept the revised Terms.

If you do not agree with the updated Terms, you must stop using the Services.

Definitions

For the purposes of these Terms:

“App” means the Truthy mobile application made available through the Apple App Store or other authorized distribution channels.

“Services” means the App, website, search features, clue submission features, candidate results, reports, photo analysis, social discovery, public information summaries, subscription features, and any related services provided by Truthy.

“User” means any person who downloads, accesses, purchases, subscribes to, or uses the Services.

“Search” means a user-initiated request using names, photos, social links, locations, or other clues to generate candidate results or reports from publicly available sources and service providers.

“User Inputs” means information voluntarily submitted by you, including names, photos, social profile links, locations, workplaces, schools, professions, notes, feedback, or other details.

“Candidate Results” means potential profile matches generated by Truthy for your review before or during report generation.

“Report” means a structured result generated by Truthy that may include social profile discovery, photo analysis, basic profile information, public insights, and related AI-generated summaries.

“Public Sources” means publicly available websites, publicly indexed webpages, public social media pages, open web sources, and other publicly accessible data sources.

“Photo Analysis” means image-based processing that may include visual similarity matching, publicly available image source checks, and profile-photo consistency signals.

“Subscription” means paid access to certain premium features, reports, or analysis functions through Apple In-App Purchase.

“Third-Party Services” means external providers, platforms, APIs, websites, app stores, data processors, payment processors, image search providers, analytics providers, hosting providers, or other third parties that help provide or support the Services.

Eligibility

The Services are intended for users who are at least 18 years old, or the age of legal majority in their jurisdiction, whichever is higher.

By using the Services, you represent and warrant that you have the legal capacity to enter into these Terms and to use the Services in accordance with all applicable laws.

You must not use the Services if you are prohibited from doing so by applicable law, regulation, court order, platform policy, or any other legal restriction.

Users are prohibited from uploading photos of minors or using the Services to search for, identify, monitor, target, or make decisions about minors.

Nature of the Services

Truthy is an AI-powered information discovery service that helps users review publicly available digital identity signals and related public information.

The Services may allow you to submit clues such as a name, photo, social link, location, workplace, school, or other details. Truthy may then generate possible candidate results, social profile findings, photo similarity signals, profile information, and public insight summaries.

Truthy does not create, own, verify, or control the underlying public information that may appear in the results. Results are generated from publicly available sources, automated systems, third-party services, and AI-based analysis.

The Services are provided for lawful, personal, non-commercial, informational use only.

Truthy is not a background check service, consumer reporting agency, employment screening provider, credit reporting service, tenant screening service, insurance eligibility service, law enforcement tool, or private investigation service.

You must not use the Services, Reports, Candidate Results, Photo Analysis, or any output generated by Truthy to determine a person’s eligibility for employment, housing, credit, insurance, education, lending, benefits, licensing, or any purpose regulated by the Fair Credit Reporting Act (“FCRA”) or similar laws.

User Responsibilities

You are solely responsible for your use of the Services and for any User Inputs you submit.

You represent and warrant that:

  1. you have the right, authorization, and lawful basis to submit any User Inputs, including photos and social links;
  2. your User Inputs are not unlawful, misleading, abusive, defamatory, invasive, discriminatory, or harmful;
  3. you will use the Services only for lawful, personal, and informational purposes;
  4. you will not rely on the Services as the sole basis for any important decision;
  5. you will independently verify any information before acting on it;
  6. you will comply with all applicable laws, regulations, platform rules, and third-party terms;
  7. you will not misuse the Services to harm, harass, threaten, intimidate, exploit, or discriminate against any person.

You are responsible for maintaining access to your device, Apple ID, purchase status, and any device-based identifiers or app data used to provide the Services. Truthy may not be able to restore certain local app states, search history, or unsaved information if you delete the App, reset your device, change devices, disable required system permissions, or otherwise modify your device environment.

User Inputs and License to Process

You retain any rights you may have in the User Inputs you submit.

By submitting User Inputs to the Services, you grant Truthy a limited, non-exclusive, worldwide, royalty-free license to access, process, transmit, analyze, display, and use such User Inputs solely as necessary to operate, provide, secure, improve, and support the Services, including generating Candidate Results, Reports, and Photo Analysis.

You acknowledge that some User Inputs may be transmitted to Third-Party Services for processing, such as hosting providers, analytics providers, image search or similarity providers, and other service providers that support the Services.

You must not submit any User Inputs that you do not have the right to use, including photos taken or obtained without proper authorization.

Truthy may provide Photo Analysis features that allow users to upload a photo for visual similarity analysis, public image source checks, or profile-photo consistency signals.

When you use Photo Analysis, your uploaded image may be processed by automated systems or Third-Party Services to compare visual features against publicly available images or related public sources.

Truthy does not guarantee that Photo Analysis can identify a person, verify a real-world identity, detect every fake or reused photo, or confirm whether an image belongs to a specific person.

Photo Analysis is based on automated visual similarity signals and publicly available information. Results may be incomplete, inaccurate, outdated, irrelevant, or misleading.

You acknowledge that:

  1. visual similarity does not prove identity;
  2. a matching or similar image does not confirm that two profiles belong to the same person;
  3. the absence of a match does not prove that a photo is authentic;
  4. the presence of a photo in public results does not prove consent, ownership, context, or current accuracy;
  5. Truthy does not control the indexing, ranking, availability, accuracy, or removal practices of third-party image sources or search providers.

You must not use Photo Analysis to stalk, harass, threaten, intimidate, discriminate, expose, blackmail, extort, dox, surveil, or otherwise harm any person.

AI-Generated Results and Public Sources

Truthy uses automated systems and AI-based methods to organize and summarize information from User Inputs, Public Sources, and Third-Party Services.

AI-generated results may be incomplete, inaccurate, outdated, duplicated, misclassified, or not unique. Public data may also contain errors, omissions, outdated records, or content provided by third parties.

Truthy does not guarantee:

  1. the accuracy, completeness, timeliness, or reliability of any result;
  2. that a Candidate Result is the person you intended to search for;
  3. that a Report contains all available public information;
  4. that any public record, profile, photo, or summary is current or complete;
  5. that a person’s identity, relationship status, history, background, risk, social presence, or conduct is accurately represented.

You are encouraged to review available sources, use your own judgment, and independently verify important information before relying on any result.

Truthy may provide a reporting or feedback feature for users to flag potentially incorrect, incomplete, outdated, or inappropriate results. We may review such reports at our discretion but are not obligated to modify, remove, verify, or correct any result.

Subscriptions, Billing, and Payment

Certain features of the Services may require a paid Subscription.

Truthy may offer weekly, annual, introductory, promotional, trial, or other subscription plans. The available plans, pricing, billing periods, renewal terms, and included features will be displayed within the App at the time of purchase.

All payments and subscription management are handled through Apple In-App Purchase. Truthy does not collect or store your credit card number, payment card security code, or full payment credentials.

Subscriptions automatically renew unless canceled according to Apple’s rules and settings. You are responsible for managing or canceling your Subscription through your Apple ID or App Store account settings.

If you cancel a Subscription, you may continue to access paid features until the end of the then-current billing period, unless Apple’s policies or applicable law provide otherwise.

Refunds are handled by Apple according to Apple’s refund policies. Truthy does not control Apple’s billing systems, refund decisions, payment authorization processes, or App Store account settings.

Truthy may change future pricing, plan scope, features, availability, trial offers, or subscription models at any time. Changes will not necessarily apply retroactively to previously purchased subscription periods unless required by law or platform policy.

Additional features, reports, credits, usage limits, one-time purchases, or premium tools may be introduced later and may require separate payment or a different subscription plan.

Search History and Report Access

Truthy may store, cache, display, limit, refresh, overwrite, or delete search-related information at its discretion and in accordance with applicable law and our Privacy Policy.

Search results and Reports may change over time because public sources, third-party services, algorithms, availability, and data quality may change.

Truthy does not guarantee that any previously generated Report, Candidate Result, unlocked content, search history, local app state, or public result will remain available indefinitely.

If the App currently operates without a registered account system, certain access, app state, or history functions may depend on device identifiers, Apple purchase status, local storage, or other technical mechanisms. Deleting the App, changing devices, resetting your device, clearing local data, or disabling certain permissions may affect access to local history or previously generated states.

Prohibited Uses

You agree not to use the Services for any unlawful, harmful, abusive, exploitative, commercial, or unauthorized purpose.

You must not:

  1. use the Services to stalk, harass, intimidate, threaten, shame, abuse, exploit, or harm any person;
  2. use the Services for unlawful surveillance, monitoring, tracking, doxing, blackmail, extortion, or identity misuse;
  3. upload photos of minors or use the Services to search for minors;
  4. upload photos without having the lawful right or authorization to do so;
  5. use results to make decisions about employment, hiring, promotion, termination, housing, tenancy, credit, lending, insurance, education, eligibility, licensing, or any regulated background screening purpose;
  6. use the Services for discrimination based on race, ethnicity, religion, gender, gender identity, sexual orientation, age, disability, nationality, marital status, or any other protected status;
  7. use the Services to violate any person’s privacy rights, publicity rights, intellectual property rights, contractual rights, or reasonable expectation of privacy;
  8. attempt to circumvent privacy settings, access controls, login restrictions, paywalls, platform rules, or technical restrictions of any third-party service;
  9. create, enrich, sell, license, or distribute databases about individuals using results from the Services;
  10. scrape, crawl, mine, harvest, extract, copy, or systematically collect data from the Services;
  11. use bots, scripts, automated systems, or non-human access methods without our written permission;
  12. reverse engineer, decompile, disassemble, modify, adapt, copy, or attempt to derive the source code of the App or Services;
  13. interfere with, overload, disrupt, damage, or compromise the Services, our servers, security systems, or networks;
  14. upload malware, viruses, tracking mechanisms, spyware, harmful code, or other disruptive materials;
  15. impersonate another person, misrepresent your identity, or provide false or misleading information;
  16. use the Services to compete with Truthy or develop a competing product, service, model, or dataset;
  17. resell, sublicense, distribute, publicly display, or commercially exploit any part of the Services or results without our written permission;
  18. submit false reports, abuse support channels, or interfere with our operations;
  19. use the Services in any way that violates applicable law, these Terms, platform rules, or third-party terms.

Violation of these Terms may result in immediate suspension or termination of access, cancellation of features, removal of data, denial of future access, and/or legal action. No refund will be provided where access is suspended or terminated due to violation of these Terms, unless required by applicable law or Apple policy.

The Services may rely on, display, link to, or interact with Third-Party Services, including public websites, public profiles, search engines, social platforms, image search services, hosting providers, analytics providers, payment processors, and other external services.

Third-Party Services are not controlled by Truthy. We are not responsible for their content, accuracy, availability, legality, privacy practices, data processing, ranking, indexing, removal decisions, or terms.

Links to third-party platforms, social media services, public profiles, records, or external websites are provided for reference only. Inclusion of such links does not imply endorsement, partnership, sponsorship, authorization, verification, or affiliation.

If you access or use a Third-Party Service, you do so at your own risk and are responsible for reviewing and complying with that third party’s terms and privacy policies.

Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, store, disclose, and protect information.

By using the Services, you agree that we may process information as described in the Privacy Policy.

If you do not agree with our Privacy Policy, you must not use the Services.

Intellectual Property Rights

The Services, including the App, website, designs, logos, characters, icons, graphics, text, workflows, interfaces, software, source code, databases, business logic, features, algorithms, models, prompts, visual elements, brand assets, documentation, and other materials, are owned by or licensed to Truthy and are protected by intellectual property and other applicable laws.

Subject to your compliance with these Terms, Truthy grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the App on a device you own or control solely for personal, non-commercial use.

You may not copy, reproduce, distribute, sell, license, modify, publicly display, create derivative works from, reverse engineer, extract, scrape, or otherwise exploit any part of the Services except as expressly permitted by these Terms or applicable law.

All rights not expressly granted to you are reserved by Truthy.

Feedback and Submissions

If you submit feedback, suggestions, reports, comments, ideas, bug reports, feature requests, or other communications regarding the Services (“Submissions”), you agree that we may use, reproduce, modify, publish, distribute, and incorporate such Submissions for any lawful purpose without compensation, attribution, or obligation to you.

You represent that you have the right to submit such Submissions and that they do not violate the rights of any third party.

Mobile Application License and Apple Terms

If you access the Services through an App downloaded from the Apple App Store, the license granted to you is limited to a non-transferable license to use the App on Apple-branded devices that you own or control and as permitted by Apple’s Usage Rules.

Apple is not responsible for providing maintenance or support for the App, except as required by applicable law.

If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, in accordance with Apple’s policies. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App.

You represent and warrant that you are not located in a country subject to applicable embargo restrictions and are not listed on any prohibited or restricted party list.

You agree to comply with applicable third-party terms when using the App.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as third-party beneficiaries.

Your use of the App is also subject to Apple’s Standard End User License Agreement: https://www.apple.com/legal/internet-services/itunes/dev/stdeula

Service Changes, Availability, and Interruptions

Truthy may change, update, suspend, remove, limit, replace, or discontinue any part of the Services at any time, with or without notice.

We do not guarantee that the Services will be uninterrupted, error-free, secure, available at all times, or compatible with every device, operating system, region, or network environment.

The Services may be unavailable due to maintenance, updates, technical issues, third-party service interruptions, network failures, force majeure events, legal requirements, or business decisions.

Truthy will not be liable for any loss, damage, inconvenience, missed opportunity, or inability to access or use the Services caused by service interruptions, modifications, suspensions, or discontinuation.

Corrections

The Services may contain errors, inaccuracies, omissions, outdated information, incorrect labels, pricing errors, availability errors, or other mistakes.

We reserve the right to correct, update, modify, remove, or revise any information in the Services at any time without prior notice.

No Warranty

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUTHY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT:

  1. THE SERVICES WILL MEET YOUR EXPECTATIONS;
  2. RESULTS WILL BE ACCURATE, COMPLETE, CURRENT, OR RELIABLE;
  3. CANDIDATE RESULTS WILL IDENTIFY THE PERSON YOU INTENDED TO SEARCH FOR;
  4. PHOTO ANALYSIS WILL VERIFY IDENTITY OR DETECT ALL MISLEADING IMAGES;
  5. PUBLIC DATA WILL BE COMPLETE, CURRENT, OR ERROR-FREE;
  6. THIRD-PARTY SERVICES WILL OPERATE PROPERLY OR HANDLE DATA IN A PARTICULAR WAY;
  7. THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR FREE OF BUGS, VIRUSES, OR HARMFUL COMPONENTS.

ANY RESULTS, REPORTS, PHOTO ANALYSIS, SOCIAL DISCOVERY, PUBLIC RECORDS, OR AI-GENERATED SUMMARIES ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE TREATED AS FACTUAL CERTIFICATION, IDENTITY VERIFICATION, LEGAL ADVICE, SAFETY GUARANTEE, BACKGROUND CHECK, OR CONSUMER REPORT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRUTHY, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, SERVICE PROVIDERS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR SIMILAR DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, PERSONAL INJURY, EMOTIONAL DISTRESS, OR OTHER DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.

WE ARE NOT LIABLE FOR:

  1. actions you take based on Candidate Results, Reports, Photo Analysis, or AI-generated outputs;
  2. incorrect, incomplete, outdated, duplicated, irrelevant, or misleading results;
  3. third-party websites, data sources, public content, APIs, platforms, or service providers;
  4. unauthorized access to or use of your device, Apple ID, purchase status, app data, or local storage;
  5. loss or corruption of User Inputs, results, history, reports, or app state;
  6. interactions with any person identified, suggested, linked, or referenced through the Services;
  7. your violation of law, third-party rights, platform rules, or these Terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO TRUTHY THROUGH THE APPLE APP STORE FOR THE SERVICES DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD \$50, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Truthy, its affiliates, directors, officers, employees, contractors, agents, licensors, service providers, and partners from and against any claims, losses, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

  1. your use or misuse of the Services;
  2. your violation of these Terms;
  3. your violation of any law or third-party right;
  4. your User Inputs, including photos or information submitted without proper rights or authorization;
  5. your misuse of Candidate Results, Reports, Photo Analysis, or AI-generated outputs;
  6. your use of the Services for stalking, harassment, surveillance, discrimination, background screening, or other prohibited purposes;
  7. any dispute between you and any person or third party arising from your use of the Services.

We reserve the right, at your expense, to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.

Termination and Suspension

These Terms remain in effect while you use the Services.

We may suspend, restrict, or terminate your access to the Services at any time, with or without notice, if we believe that:

  1. you violated these Terms or our policies;
  2. your use may create legal, security, operational, reputational, or safety risks;
  3. your use violates applicable law or third-party rights;
  4. payment is not completed, renewed, or authorized;
  5. you misuse results or use the Services for prohibited purposes;
  6. we are required to do so by law, platform policy, regulator request, or court order;
  7. continued access is no longer commercially or technically feasible.

Termination or suspension may result in loss of access to paid features, search history, reports, local app state, or other data, subject to applicable law and Apple policies.

Sections that by their nature should survive termination will survive, including intellectual property, prohibited uses, disclaimers, limitation of liability, indemnification, dispute resolution, privacy-related provisions, and miscellaneous provisions.

User Data

We may maintain certain data transmitted through the Services as necessary to operate, secure, troubleshoot, improve, or provide the Services, subject to our Privacy Policy.

Although we may use reasonable technical measures to preserve service integrity, you are responsible for maintaining your own records of information that is important to you.

We are not liable for loss, corruption, unavailability, deletion, or failure to store User Inputs, results, search history, reports, or other data.

Electronic Communications

By using the Services, contacting us, submitting forms, making purchases, or interacting with the App, you consent to receive electronic communications from us.

You agree that all agreements, notices, disclosures, policies, receipts, records, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

You agree to the use of electronic records, electronic signatures, and electronic delivery of notices and transaction records, to the extent permitted by law.

California Users and Residents

If you are a California resident and any complaint regarding the Services is not resolved to your satisfaction, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at:

This section does not limit any rights you may have under applicable consumer protection or privacy laws.

Governing Law

These Terms and any dispute arising out of or relating to the Services will be governed by the laws of Hong Kong, without regard to conflict of law principles, unless mandatory consumer protection laws in your country of residence require otherwise.

If you are a consumer located in a jurisdiction that provides mandatory legal protections, nothing in these Terms limits rights that cannot be waived under applicable law.

Dispute Resolution

Before initiating any formal proceeding, you and Truthy agree to first attempt to resolve any dispute informally by contacting each other in writing and allowing at least thirty (30) days for good-faith negotiation.

If the dispute cannot be resolved informally, the dispute will be submitted to the courts or arbitral forum specified by applicable law and the governing jurisdiction above, unless mandatory law provides otherwise.

Nothing in this section prevents either party from seeking injunctive or equitable relief for intellectual property misuse, unauthorized access, security abuse, privacy violations, or unlawful use of the Services.

Class actions, representative actions, or consolidated proceedings are waived to the maximum extent permitted by applicable law.

Miscellaneous

These Terms, together with the Privacy Policy and any additional terms incorporated by reference, constitute the entire agreement between you and Truthy regarding the Services.

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, sale of assets, restructuring, or by operation of law.

No joint venture, partnership, employment, agency, or fiduciary relationship is created between you and Truthy as a result of these Terms or your use of the Services.

We are not responsible for failure or delay caused by events beyond our reasonable control, including natural disasters, war, labor disputes, internet failures, platform outages, government actions, legal restrictions, third-party failures, or force majeure events.
